About the Wealthsimple Crypto Giveaway and how to qualify

Starting on November 22, 2024, and running until 11:59pm ET on December 20, 2024, eligible entrants will be entered to win one (1) bitcoin.

There are four (4) ways to enter:

1. Open and fund a Crypto account with at least $1
2. Refer a friend who opens and funds a Crypto account
3. Repost and reply on X (Twitter) with #WealthsimpleCrypto and #contest
4. Find us on Instagram, tag a friend and share the post with #WealthsimpleCrypto and #contest

Number  of entries:

• On social: one entry per channel (X or IG; 2 max.)
• New account opening: 1 entry
• New account funding: 1 entry
• Referrals: 3 entries per referred friend (no max)

The winner will be drawn on or around December 23, 2024, one (1) entry will be selected via random drawing from among eligible entries received during the Contest Period. The prize will be distributed within 10 business days of identifying the Winner.

CONTEST RULES

NO PURCHASE IS NECESSARY

THE CONTEST IS INTENDED TO BE CONDUCTED ONLY IN CANADA AND SHALL BE CONSTRUED AND EVALUATED ACCORDING TO APPLICABLE CANADIAN LAW. VOID IN WHOLE OR IN PART WHERE PROHIBITED BY LAW. ENTRY IN THE CONTEST CONSTITUTES ACCEPTANCE OF THESE CONTEST RULES (THE “CONTEST RULES”).

CONTEST PERIOD: The contest period will begin at 12:01am Eastern Time (“ET”) on November 22, 2024, and will end at 11:59pm ET on December 20, 2024 (the “Contest Period”), after which time the Contest will be closed and no further entries shall be accepted.

ELIGIBILITY: To enter and be eligible to win, the entrant must be:

• a resident of Canada;
• the age of majority, or older, in your province/territory of residence or older at the time of entry; and
• meet the entry requirements set out below

(each an “Entrant”).

Employees, officers and directors of Wealthsimple and its partners and associate companies, and each of their advertising and promotional agencies and their respective affiliates and associates, and such individual’s immediate family members and persons with whom such individuals are domiciled, are not eligible to enter or participate in the Contest. For the purposes of the Contest Rules, “immediate family” refers to the father, mother, brothers, sisters, children, husband, wife or partner of such an employee, agent and/or representative.

Wealthsimple shall have the right at any time to require proof of identity and/or eligibility to participate in the Contest. Failure to provide such proof may result in disqualification. All personal and other information requested by and supplied to Wealthsimple for the purpose of the Contest must be truthful, complete, accurate and in no way misleading. Wealthsimple reserves the right, in its sole discretion; to disqualify the Entrant, should such the Entrant at any stage supply untruthful, incomplete, inaccurate or misleading personal details and/or information.

HOW TO ENTER: No purchase necessary. There are four (4) methods to enter into the Contest:

METHOD #1: To obtain one (1) entry via this method, eligible Entrant who have not previously created a Wealthsimple Crypto (“Crypto”) account, or have previously created a Crypto account but never funded the account, will need to have an active Crypto account and fund at least CAD$1 into that account during the Contest Period. This method is only valid for individuals who meet the eligibility requirement to open a Crypto account. Limit one (1) entry per Entrant during the Contest Period via this method.

Crypto is offered by Wealthsimple Investments Inc. (“WSII”), a member of the Canadian Investment Regulatory Organization (“CIRO”). Crypto assets purchased and held in an account with Crypto are not protected by the Canadian Investor Protection Fund, the Canadian Deposit Insurance Corporation or any other investor protection insurance scheme. METHOD #2: At the start of the Contest Period, Wealthsimple will post social media posts related to the Contest (a “Contest Post”) on X (formerly Twitter) at www.x.com/Wealthsimple (@wealthsimple). To obtain one (1) entry via this method, eligible Entrants will need to retweet the Contest Post, including the hashtags #wealthsimplecrypto and #contest in the retweet during the Contest Period. Limit of one (1) entry per Entrant during the Contest Period via this method.

METHOD #3 : At the start of the Contest Period, Wealthsimple will post Contest Posts related to the Contest on Instagram at https://www.instagram.com/wealthsimple (@wealthsimple). To obtain one (1) entry via this method, tag at least one friend in the “Comment” section of the Contest Post and reshare the Contest Post, including the hashtags #wealthsimplecrypto and #contest in the reshared post, during the Contest Period. Limit of one (1) entry per Entrant during the Contest Period via this method.

METHOD #4: To obtain three (3) entries via this method, eligible entrant must successfully refer an individual, who has never previously registered for a Crypto account, to open a Crypto account and fund at least CAD$1 into that account during the Contest Period. There is no limit to the number of entries via this method so long as each referral is a different individual and that individual satisfies the condition to open and fund a Crypto account.

In order to participate in the Contest via the social media methods, Entrants must have a valid X or Instagram account in good standing, and such accounts cannot be set with “protected” updates during the Contest Period and when the prize is claimed. Entrants who do not have a X or Instagram account may sign up on their own accord at www.x.com and/or www.instagram.com. All terms and conditions of creating and maintaining these accounts are governed by X and Instagram and not Wealthsimple.

Where there is a dispute in the Entrant’s identity with the social media entry methods, the authorized account holder of the X Instagram profile used for the submitted entry shall be deemed the Entrant. For greater certainty, “authorized account holder” is defined as the natural person assigned to the X or Instagram profile by X and Instagram. Wealthsimple shall have the right at any time to require proof of identity and/or eligibility to participate in the Contest. Failure to provide such proof may result in disqualification. All personal and other information requested by and supplied to Wealthsimple for the purpose of the Contest must be truthful, complete, accurate and in no way misleading. Wealthsimple reserves the right, in its sole discretion; to disqualify the Entrant, should such the Entrant at any stage supply untruthful, incomplete, inaccurate or misleading personal details and/or information.

Notwithstanding the above criteria, each entry via the social media entry method must also satisfy the following requirements to be considered a valid entry, specifically, it shall not: (i) include any person’s likeness without permission, (ii) include any defamatory terms or statements on any individual, place, business, group, Wealthsimple or any other entities associated with Wealthsimple, (iii) contain personal or commercial solicitations, advertisements or promotional materials, (iv) invade privacy or other rights of any individual or entity, (v) contain any materials that are unlawful or inappropriate, profane, obscene, offensive, hateful, libelous. Wealthsimple reserves the right, in its sole discretion, to remove and disqualify any individual who is found to be in violation of the requirements of these Contest Rules. 

PRIZES/DRAW: One (1) prize available to be won in Canada, consisting of one (1) Bitcoin (a “Prize”).  The Prize is non-exchangeable, non-transferable, non-refundable, and must be accepted as awarded with no substitutions. Wealthsimple reserves the right, for any reason and in its sole discretion, to substitute and/or modify the Prize with another prize that is of equal or greater value. The Prize will be sent to the selected Entrant(s) that satisfied the requirement of this Contest (each a “Winner”) via deposit in Canadian currency to the Winner’s Wealthsimple Crypto account. The Winner is solely responsible for any costs or expenses related to the Prize, including, but not limited to, any capital gains derived from the Prize.

If, at the time of Winner Notification (as defined below), the Winner does not have a Wealthsimple Crypto account, they will be required to open one within the prescribed time as a condition of receiving the Prize. There are no fees associated with the creation of a Wealthsimple Crypto account. All of the Winner’s Wealthsimple accounts must be in good standing at the time of entry and/or at the time the Prize is awarded. The Contest is not a recommendation to trade any security or cryptocurrency. 

On or around December 23, 2024 at approximately 05:00 pm ET in Toronto, ON (“Draw Date”), one (1) entry will be selected via random drawing from among eligible entries received during the Contest Period. Prize(s) will be distributed within 10 business days of identifying the Winner(s).

ODDS: The odds of being selected as a potential Winner are dependent upon the number of eligible entries received by Wealthsimple via the various methods during the Contest Period. Maximum of one (1) Prize per Entrant.

WINNER NOTIFICATION: Within two (2) business days of the Draw Date, Wealthsimple, acting reasonably, will attempt to contact the potential Winner(s) of the Contest via their method of entry (“Winner Notification”). The selected Entrant must confirm receipt of the Winner Notification, and complete all steps outlined therein, including the completion of a Winner Declaration and Release. In the event a potential Winner cannot be contacted by 11:59:59 PM ET two (2) days after the Winner Notification or there is a return of any notification as undeliverable, or otherwise does not meet the eligibility or Contest requirements, they may be disqualified and Wealthsimple reserves the right, in its sole discretion, to follow the provisions and procedures referred to above relating to selection and notification of a potential Prize winner, with the necessary amendments, until a qualified Prize winner has been duly selected, or there are no more eligible entries, whichever occurs first. Wealthsimple is not responsible for the failure for any reason whatsoever of a selected Entrant to receive notification or for Wealthsimple to receive a selected Entrant’s response.

No correspondence will be entered into except with Entrants requesting the Contest Rules by mail or requesting the name(s) of the Winner for which a self-addressed, postage paid envelope must be included. Requests should be addressed to Wealthsimple’s Chief Compliance Officer at 400-80 Spadina Avenue, Toronto, ON, M5V 2J4.

SKILL TESTING QUESTION: Before being declared a Winner, the potential Winner shall be required to correctly answer, without assistance of any kind, whether mechanical or otherwise, a time-limited mathematical skill-testing question to be administered in the Winner Declaration and Release form, to comply with the Contest Rules, and to sign and return the Release within the period specified by Wealthsimple.

RELEASE: By entering the Contest, the Entrant agrees to release and to hold Wealthsimple and its parent companies, subsidiaries, affiliates, related and associated entities, employees, directors, officers, suppliers, agents, sponsors and administrators (the “Releasees”) harmless from any and all liability for any injuries, loss or damage of any kind to the Entrant or any other person, including personal injury, death, or property damage, resulting in whole or in part, directly or indirectly, from acceptance, possession, use or misuse of any Prize, participation in the Contest, any breach of the Contest Rules, or in any Prize-related activity. The Entrant agrees to fully indemnify Wealthsimple, and the Releases from any and all claims by third parties relating to the Contest, without limitation.

Wealthsimple assumes no responsibility or liability for lost, late, unintelligible/illegible, falsified, damaged, misdirected or incomplete entries, notifications, responses, replies or any Release, or for any computer, online, software, telephone, hardware or technical malfunctions that may occur, including but not limited to malfunctions that may affect the transmission or non-transmission of an entry. Wealthsimple is not responsible for any incorrect or inaccurate information, whether caused by website users or by any of the equipment or programming associated with or utilized in the Contest or by any technical or human error which may occur in the administration of the Contest. Wealthsimple assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, entries. Wealthsimple is not responsible for any problems, failures or technical malfunction of any telephone network or lines, computer online systems, servers, providers, computer equipment, software, e-mail, players, applications or browsers, on account of technical problems or traffic congestion on the Internet, at any website or application, or on account of any combination of the foregoing or otherwise. Wealthsimple is not responsible for any injury or damage to the Entrant or to any computer related to or resulting from participating or downloading materials in the Contest. The entrant assumes liability for injuries caused or claimed to be caused by participating in the Contest, or by the acceptance, possession, use of, or failure to receive any Prize. Wealthsimple assumes no responsibility or liability in the event that the Contest cannot be conducted as planned for any reason, including those reasons beyond the control of Wealthsimple, such as infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or corruption of the administration, security, fairness, integrity or proper conduct of the Contest, the Contest website(s) and/or the Contest application(s). Wealthsimple assumes no responsibility for entries which fail to comply with the Contest Rules. Wealthsimple assumes no responsibility for any failure of Wealthsimple’s website or application during the Contest Period, including any problems or technical malfunctions of any computer on-line systems, servers, computer equipment, software, failure of any e-mail, notification or entry to be received on account of technical problems or traffic congestion on the Internet, any website, any application, or any combination thereon. 

Wealthsimple reserves the right, in its sole discretion, to terminate the Contest, in whole or in part, and/or modify, amend or suspend the Contest, and/or the Contest Rules in any way, at any time, for any reason without prior notice.

PUBLICITY: Unless prohibited by law, the Winner agrees that by accepting a Prize, Wealthsimple may use the Winner’s name, likeness, photo, video, city of residence, biographical information, prize information and/or statements about this Contest for publicity purposes with no compensation, notification or permission.

TAMPERING: All entries are subject to verification. By participating in the Contest, the Entrant agrees to be bound by the Contest Rules. The Entrant further agrees to be bound by the decisions of Wealthsimple, which shall be final and binding in all respects. Wealthsimple reserves the right, in its sole discretion, to disqualify any Entrant found to be:

1. violating the Contest Rules;
2. tampering or attempting to tamper with the entry process or the operation of the Contest, the Contest website, the Contest application or any related promotional website or application;
3. using any automated, script, macro, robotic or other program(s) to enter or otherwise participate in the Contest; or
4. acting in an unsportsmanlike or disruptive manner, or with intent to annoy, abuse, threaten or harass any other person.

CAUTION: ANY ATTEMPT TO DELIBERATELY DAMAGE THE CONTEST WEBSITE, THE CONTEST APPLICATION OR OTHERWISE UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS. SHOULD SUCH AN ATTEMPT BE MADE, WEALTHSIMPLE RESERVES THE RIGHT TO SEEK REMEDIES AND DAMAGES TO THE FULLEST EXTENT PERMITTED BY LAW, INCLUDING BUT NOT LIMITED TO CRIMINAL PROSECUTION.

INTELLECTUAL PROPERTY: All intellectual property, including but not limited to, trade-marks, trade-names, logos, designs, promotional materials, web pages, source codes, drawings, illustrations, slogans and representations used in connection with the Contest are the property of Wealthsimple and/or its affiliates. All rights are reserved. Unauthorized copying or use of any copyrighted material or intellectual property without the express written consent of its owner is strictly prohibited.

COLLECTION OF INFORMATION: By entering the Contest, the Entrant understands and agrees that Wealthsimple will collect, use and disclose their personal information only in relation to the Contest, as well as in accordance to the Privacy Policy as applicable to their Wealthsimple account. Any questions regarding Wealthsimple’s Privacy Policy or the treatment of your personal information should be directed to Wealthsimple’s Chief Compliance Officer at 400-80 Spadina Avenue, Toronto, ON, M5V 2J4.

CONSTRUCTION: The Contest is void where prohibited by law and is subject to all applicable federal, provincial and municipal laws and regulations. The Contest Rules are subject to change without notice in order to comply with any applicable federal, provincial and municipal laws or the policy of any other entity having jurisdiction over Wealthsimple. All issues and questions concerning the construction, validity, interpretation and enforceability of the Contest Rules or the rights and obligations as between the entrant and Wealthsimple in connection with the Contest shall be governed by and construed in accordance with the laws of the province of Ontario including procedural provisions without giving effect to any choice of law or conflict of law rules or provisions that would cause the application of any other jurisdiction’s laws. All dollar amounts referred to in the Contest Rules are stated in Canadian Dollars.

Invalidity or unenforceability of any provisions, in part or in full of these Contest Rules shall not affect the validity or enforceability for the remainder of the rules. The Contest Rules shall be interpreted as if the invalid or unenforceable provisions were not included, should such provisions exist.

In the event of any discrepancy or inconsistency between the terms and conditions of the Contest Rules and disclosures or other statements contained in any Contest related materials, including but not limited to the Contest entry form, or point of sale, television, print or online advertising, the terms and conditions of the Contest Rules shall prevail, govern and control.
